- performance of a contract, to process orders, subscriptions, returns and warranty claims and to provide services you request;

- legal obligation, where we must process personal information to comply with law, including tax, accounting, consumer protection and product safety requirements.
Where a safety incident report includes information about your health, we process it only to the extent necessary to handle the report, comply with our legal obligations or establish, exercise or defend legal claims, or with your explicit consent where required by law.
Where we rely on consent, you may withdraw it at any time. Withdrawal will not affect processing that took place before your withdrawal.
6. How we share personal information
6.1 Service providers
We share personal information with service providers that help us operate our business. Depending on the technologies and services actually used, these currently include:
- Shopify, for website hosting, e-commerce platform functionality, checkout, customer accounts, Shopify Analytics and fraud screening. You can read more about how Shopify uses personal information at https://www.shopify.com/legal/privacy;

- ShipBob, our fulfilment provider, and carriers, mainly FedEx, UPS and USPS, together with other carriers and logistics partners we may use from time to time, for fulfilment and delivery.
6.2 Other recipients
We may also share personal information with:
- customs authorities, brokers and carriers, where required for international shipments;
- payment providers, in connection with chargebacks and payment disputes;
- insurers, suppliers, manufacturers and professional advisers, where reasonably necessary to investigate claims, defects or safety incidents or to obtain advice;

Some third parties, including analytics and advertising providers, may also use the information they collect in accordance with their own privacy notices.
7. Sale, sharing and targeted advertising
We do not sell personal information for money. However, some US state privacy laws treat certain uses of cookies, pixels and similar technologies for analytics or advertising as a “sale” of personal information, “sharing” of personal information for cross-context behavioural advertising, or “targeted advertising”.
Google Tag, Meta Pixel and TikTok Pixel are installed on the Site but, as at the date of this Privacy Policy, are not currently used for active campaigns. Where applicable law requires it, we will provide a “Do Not Sell or Share My Personal Information” or equivalent link, recognise valid Global Privacy Control signals and honour eligible privacy choices, as described in Section 13 and in our Cookie Policy.
8. Cookies and similar technologies
We use cookies and similar technologies for strictly necessary, functional and analytics purposes and, where advertising technologies are actively used, for advertising purposes. Where required by law, including in the United Kingdom and European Union, we only use non-essential cookies after obtaining your consent through our Shopify standard cookie banner or preference centre. You may update your preferences at any time by selecting the “Cookie Settings” link or equivalent control made available on the Site.
Full details are set out in our Cookie Policy below.
9. Marketing and service communications
Where you have agreed to receive marketing, or where otherwise permitted by law, we may send you marketing emails or SMS messages about our products and offers. You may unsubscribe at any time by using the unsubscribe link or instructions in the message, or by contacting us at hello@trycoolbreath.com.
Service communications, such as order confirmations, dispatch notifications, renewal notices, failed-payment notices, cancellation confirmations and safety or recall notices, are distinct from marketing communications and may be sent even if you opt out of promotional marketing, where permitted by law.
Where a subscription offering is made available and you enrol, we will send a reminder email 3 days before each renewal, as described in our Subscription and Auto-Renewal Terms.
10. International transfers
We are based in the United States, and our service providers may process personal information in the United States and in other countries. These countries may have data protection laws that differ from those in your country.
Where we transfer personal information from the United Kingdom, the European Economic Area, Switzerland or another jurisdiction that restricts international transfers, we will use the safeguards required by applicable law, which may include adequacy decisions, standard contractual clauses or other lawful transfer mechanisms.
11. Data retention
We keep personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including:
- order and transaction records, for as long as needed to fulfil the order and to meet tax, accounting and other legal requirements;
- subscription information, for as long as your subscription is active and afterwards as needed to handle final orders, refunds, disputes and legal obligations;
- returns, warranty and safety incident information, for as long as needed to handle the claim or report and any related dispute, regulatory requirement or legal claim;
- marketing information, until you unsubscribe or ask us to delete it, subject to keeping a record of your opt-out; and
- cookie data, for periods that depend on the specific cookie and its purpose, as explained in our Cookie Policy.
When personal information is no longer needed, we will delete or anonymise it, unless we are required by law to keep it for longer.
12. Security
We use reasonable technical and organisational measures designed to protect personal information against loss, misuse and unauthorised access, disclosure, alteration or destruction. Payment information is processed by our payment service providers and, for subscriptions, payment credentials are stored using secure tokenisation or equivalent methods, as described in our Subscription and Auto-Renewal Terms.
No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your account login credentials confidential.
13. Your rights and choices
Depending on where you live, you may have some or all of the following rights in relation to your personal information:

- to correct inaccurate or incomplete personal information;
- to delete your personal information;
- to object to or restrict certain processing;

- to withdraw consent, where we rely on consent;

To exercise your rights, please contact us at hello@trycoolbreath.com. We may need to verify your identity before responding, and we will respond within the time required by applicable law. Where permitted by law, you may use an authorised agent to submit a request on your behalf. We will not discriminate against you for exercising your privacy rights.
Some rights are subject to exceptions, for example where we must keep personal information to comply with a legal obligation or to establish, exercise or defend legal claims.
Disputes relating to privacy are subject to the dispute resolution provisions in Section 27 of our Website Terms and Conditions, including the informal dispute resolution, arbitration and opt-out provisions, subject always to mandatory law. Nothing in this paragraph limits any right you may have to complain to a data protection authority.
13.1 United Kingdom, European Economic Area and Switzerland
If you are located in the United Kingdom, the European Economic Area or Switzerland, you have the rights described above under applicable data protection law, including the right to lodge a complaint with your local data protection supervisory authority. Depending on your state of residence, you may have rights under state privacy laws to know about, access, correct and delete personal information, and to opt out of the sale of personal information, sharing for cross-context behavioural advertising and targeted advertising. Where applicable, we will provide a “Do Not Sell or Share My Personal Information” or “Your Privacy Choices” link and recognise Global Privacy Control signals where legally required.
If we decline your request, you may appeal our decision by contacting us at hello@trycoolbreath.com. If your appeal is denied, you may be able to contact your state attorney general.
13.3 Canada
If you are located in Canada, you may request access to and correction of your personal information and withdraw your consent to certain processing, subject to legal and contractual restrictions. You may also contact the Office of the Privacy Commissioner of Canada or your provincial privacy regulator.
13.4 Australia
If you are located in Australia, we handle personal information in accordance with the Australian Privacy Principles where they apply to us. You may request access to and correction of your personal information. If you are not satisfied with our response to a privacy complaint, you may contact the Office of the Australian Information Commissioner.
13.5 New Zealand
If you are located in New Zealand, you may request access to and correction of your personal information under the Privacy Act 2020. You may also contact the Office of the Privacy Commissioner.
13.6 Other jurisdictions
If you are located elsewhere, you may have rights under local law. Please contact us at hello@trycoolbreath.com and we will respond in accordance with applicable law.
13.7 Do Not Track and Global Privacy Control
There is currently no common industry standard for responding to “Do Not Track” browser signals. Where applicable law requires us to do so, we recognise valid Global Privacy Control (GPC) signals as described in our Cookie Policy.
14. Children’s data
The Site and our products are intended only for individuals who may lawfully purchase, receive and use them in their place of residence and in any place where the products are delivered.
Cool Breath does not intentionally collect personal data directly from children in a manner not permitted by applicable law. If we become aware that personal information has been submitted by or collected from a child in a manner not permitted by applicable law, we may take reasonable steps to delete or anonymise the information where appropriate and take any further action reasonably necessary to comply with law.
If you report a safety incident or accidental exposure involving a child or another person, we use that information only to handle the report, provide support and meet our legal obligations.
15. Third-party websites and services
The Site may contain links to third-party websites, tools, payment gateways, social media features or external services. We do not control and are not responsible for their content or privacy practices. Your use of third-party services is subject to the relevant third party’s own terms and privacy notices.
16. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in law, our practices, the services and technologies we use, or for other operational, legal or regulatory reasons. We will post the updated version on the Site and amend the Last updated date. Where changes are material and notice is required by law, we will provide that notice.

This Cookie Policy explains how Big Creative Group LLC, trading as Cool Breath (“Cool Breath”, “we”, “us” or “our”), uses cookies and similar technologies on the Cool Breath website at https://trycoolbreath.com/, including our Shopify storefront, checkout, customer account, marketing pages and subscription pages.
Cool Breath operates internationally, with a primary commercial focus on the United States, and sales activity also directed to Canada, the United Kingdom, the European Union and Australia. This policy is intended to work alongside our Privacy Policy and should be read together with it.
This Cookie Policy is designed to:
- explain what cookies and similar technologies are;
- describe the categories of cookies we may use;
- explain when consent is required;
- explain how you can manage your preferences, including withdrawing consent;
- address region-specific choices, including UK/EU consent rules and US privacy choices where applicable; and

Who we are
Controller / website operator: Big Creative Group LLC, trading as Cool Breath, 8 The Green #12682, Dover, DE 19901, United States
If you have questions about this Cookie Policy or our use of cookies and similar technologies, please contact us at hello@trycoolbreath.com.
What are cookies and similar technologies?
Cookies are small text files placed on your device when you visit a website. They help websites function, remember your preferences, understand how visitors use the site and support marketing activities.
We may also use similar technologies, including:
- pixels or tags;
- software development kits (SDKs);
- local storage and session storage;
- device identifiers;
- server-side tracking tools; and
- web beacons.
For ease of reading, this policy refers to all of these as “cookies” unless the context requires otherwise.
Why we use cookies
We may use cookies for the following purposes:
- to ensure the website and checkout function properly;
- to remember your settings and preferences;
- to support shopping basket, account and any subscription app functionality;
- to process and secure payments through Shopify Payments, PayPal and related payment security tools;
- to measure website traffic and performance through analytics technologies such as Shopify Analytics, Google Analytics, Meta Analytics or other tracking apps;
- to understand how users interact with pages, products and checkout flows;
- to personalize content and promotions;
- to measure the effectiveness of advertising campaigns, including through Google Tag, Meta Pixel and TikTok Pixel where those tools are used; and
- to support fraud prevention, security and legal compliance.
Categories of cookies we use
We group cookies into the following categories.
1. Strictly necessary cookies
These cookies are required for the operation of the website and cannot generally be switched off through our Shopify standard cookie banner or preference centre. They are used for core functions such as:
- page navigation;
- load balancing;
- website security;
- fraud prevention;
- remembering items in your basket;
- secure checkout;
- account login;
- payment session management; and
- order continuity and subscription continuity.
Because these cookies are necessary to provide the service you request, they do not usually require prior consent under UK and EU rules. However, they must still be described transparently.
2. Functional cookies
These cookies allow the website to remember choices you make and provide enhanced features. They may be used to remember:
- language or region preferences;
- account-related settings;
- saved preferences for non-essential cookies;
- accessibility or interface choices; and
- support or chat preferences, where enabled.
If these cookies are not strictly necessary, they will only be used where required consent has been obtained.
3. Analytics cookies
Analytics cookies and similar technologies, including Shopify Analytics, Google Analytics, and Meta Analytics, help us understand how visitors use the website so that we can improve content, navigation, product pages, checkout journeys and subscription app flows. They may collect information such as:
- pages visited;
- traffic sources;
- device and browser information;
- session behavior;
- error rates;
- conversion events; and
- whether a visitor starts or abandons checkout.
Where required by law, including in the United Kingdom and European Union, we will only use non-essential analytics cookies after obtaining your consent.
4. Advertising cookies
Advertising cookies and similar technologies, including Google Tag, Meta Pixel and TikTok Pixel where used for marketing measurement, help us and our advertising partners deliver and measure marketing campaigns. They may be used to:
- measure the effectiveness of advertisements;
- understand whether you clicked on an advert and made a purchase;
- build audiences for remarketing;
- limit repeated display of adverts;
- personalise advertising across websites, apps and social media; and
- support targeted advertising, including through Google, Meta, TikTok or similar marketing technologies, where actively used for campaigns.
Where required by law, including in the United Kingdom and European Union, we will only use non-essential advertising cookies after obtaining your consent. Google Tag, Meta Pixel and TikTok Pixel are installed but, as at the date of this policy, are not currently used for active campaigns.
First-party and third-party cookies
Cookies may be:
- first-party cookies, which are set by Cool Breath or on our behalf; or
- third-party cookies, which are set by external providers whose tools or content are used on our website.
Depending on the technologies actually deployed on the live website, third-party technologies may be associated with services relating to:
- Shopify website hosting and e-commerce platform functionality;
- checkout and payment processing through Shopify Payments and PayPal;
- subscriptions and recurring billing through subscription apps;
- analytics and performance measurement through Shopify Analytics, Google Analytics, Meta Analytics and other tracking apps;
- advertising, pixels, tags and social media measurement through Google Tag, Meta Pixel, TikTok Pixel and other tracking apps, noting that Google Tag, Meta Pixel and TikTok Pixel are installed but are not currently used for active campaigns; and
- fraud prevention, security, customer service through Gmail, email/SMS messaging through an autonomous B2C CRM, fulfilment through ShipBob and carrier services, mainly through FedEx, UPS and USPS.
Third parties may use the information they collect in accordance with their own privacy notices. Where required, we will identify these providers in our cookie inventory and Shopify standard cookie banner or consent tools.
How long cookies last
Cookies may remain on your device for different periods:
- session cookies expire when you close your browser; and
- persistent cookies remain for a longer period, until they expire automatically or are deleted manually.
The retention period depends on the specific cookie and its purpose. We aim to ensure that cookie durations are proportionate to the purpose for which they are used.
Exact cookie names, providers, purposes and durations must be completed from a live cookie scan of https://trycoolbreath.com/ before final publication. The current implementation stack includes Shopify, Shopify Payments, PayPal, Seal Subscription, Klaviyo, Shopify Analytics, Google Analytics, Meta Analytics, Triple Whale, Google Tag, Meta Pixel, TikTok Pixel, Gmail, ShipBob and carriers mainly FedEx, UPS and USPS, but this policy does not invent exact cookie names or durations that have not been verified by a live scan.
Legal bases and consent
UK, EEA and other prior-consent jurisdictions
Where the law requires prior consent for non-essential cookies, including in the United Kingdom and European Union, we will:
- place strictly necessary cookies without prior consent where permitted;
- ask for your consent before placing functional, analytics or advertising cookies that are not strictly necessary, including non-essential analytics and advertising cookies used for Shopify Analytics, Google Analytics, Meta Analytics, Google Tag, Meta Pixel or TikTok Pixel where applicable;
- provide a genuine choice to accept, reject or customise non-essential cookies; and
- make it as easy to withdraw consent as it was to give it.
Your refusal of non-essential cookies will not prevent you from using the website, although some optional features may not work as intended.
United States and other relevant jurisdictions
In the United States, cookie-related disclosures may interact with state privacy laws, particularly where cookie-based advertising involves:
- sale of personal information;
- sharing of personal information for cross-context behavioural advertising; or
- targeted advertising.
Where applicable, we will provide a “Do Not Sell or Share My Personal Information” or equivalent link and honour eligible privacy choices as required by applicable law.
In some jurisdictions, analytics or advertising cookies, if deployed, may also require an opt-out or consent-based mechanism. We therefore use a region-sensitive approach where appropriate.
Global Privacy Control and similar signals
Where applicable law requires us to do so, we will recognise valid browser-based Global Privacy Control (GPC) or similar opt-out preference signals as a request to opt out of:
- sale of personal information;
- sharing of personal information; and/or
- targeted advertising,
to the extent the signal is legally required to be honoured and can be technically linked to the relevant browser or device.
Please note:
- GPC may apply only to the browser and device from which the signal is sent;
- it may not automatically apply across all devices or browsers you use; and
- strictly necessary cookies may still be used even if GPC is enabled.
How to manage your cookie preferences
You can manage cookies in several ways.
Preference centre
Where available, you can use our Shopify standard cookie banner or cookie preference centre to:
- accept all cookies;
- reject all non-essential cookies; or
- choose categories individually.
You may revisit and update your preferences at any time by selecting the “Cookie Settings” link or equivalent control made available on the website through the Shopify standard cookie banner or preference centre.
Withdrawing consent
If you previously consented to non-essential cookies, you may withdraw that consent at any time through the Shopify standard cookie banner or preference centre, where available. Withdrawal will not affect processing that took place before your withdrawal.
Browser controls
Most browsers allow you to manage cookies through browser settings. You may be able to:
- block all cookies;
- block third-party cookies;
- delete existing cookies;
- clear browsing data when you close the browser; or
- set alerts before cookies are stored.
Please note that disabling certain cookies may affect website performance and functionality, particularly for basket, Shopify checkout, account and any subscription app features.
Device and platform settings
If you access the website through a mobile device, some advertising and privacy settings may also be available at device or platform level.
US privacy choices for sale, sharing and targeted advertising
Depending on your state of residence and applicable law, you may have rights to opt out of certain uses of personal information connected with cookies and similar technologies, including:
- sale of personal information;
- sharing for cross-context behavioural advertising; and
- targeted advertising.
Where required, we will offer an appropriate mechanism, such as:
- a “Do Not Sell or Share My Personal Information” link;
- a “Your Privacy Choices” link;
- recognition of Global Privacy Control where legally required; or
- a combination of the above.
These choices generally do not disable strictly necessary cookies.
Consequences of refusing cookies
If you reject non-essential cookies:
- the website should still function for essential browsing and checkout purposes;
- some personalisation or convenience features may be unavailable;
- analytics data may be limited; and
- advertising may be less relevant or less measurable.
Changes to this Cookie Policy
We may update this Cookie Policy from time to time to reflect changes in:
- law or regulatory guidance;
- our website functionality;
- our use of cookies or similar technologies; or
- the third-party tools deployed in connection with the website, Shopify checkout, Shopify Payments, PayPal, subscription apps, autonomous CRM, analytics, pixels/tags, customer service, fulfilment, carriers or marketing.
We will post the updated version on the website and amend the Last updated date below.
